Regulatory Approvals and Sanctions – For setting-up factories/ plants
SCOPE OF WORK
PRE-CONSTRUCTION REGISTRATIONS
- Fire Service Department Clearance (Fire NOC) (one time)
Approval needs to be obtained from the Fire Service Department to comply that the establishment adheres with Fire Safety Standards. The permission is given in two stages. First, NOC is issued by the competent authority on receiving the building plan for new units. After construction of the building, the final NOC is issued after completion of the compliances and documentation.
- Consent to Establish (CTE) (Environment Permission)
As per Section 25 of Water (Prevention and Control of Pollution) Act- 1947 and Section 21 of the Air (Prevention and Control of pollution Act 1981 the SPCB is authorized to issue no objection for setting up of a new industry. Every new manufacturing set up cannot construct or operate a factory unless it has obtained the CTE from State Pollution Control Board (SPCB). We assist Client in making all necessary application, follow up, inspections and support in obtaining the Consent to Establish from SPCB.
- Labor License, (Principal Employer Registration) (one time)
Prior to commencement of construction, the Company needs registration with Labor and Employment Department, State Government, as ‘Principal Employer’ to hire contractual labor and to meet workmen contractual obligations.
- Factory Map Approval Under Factories Act (one time)
Before starting construction of Factory, registration is required with Directorate of Industrial Safety & Health, to approve the plan layout of factory under The Factories Act, 1948. Registration is required to obtain permission to construct, extend or take into use any building as a factory, approval of plans of building and layout of plant and machineries.
- Registration under The Building and Other Construction Workers Act (‘BOCW’) (one time)
Registration is applicable to the establishment which employs ten or more building workers in any building or other construction work. BOCW Cess of 1 percent is payable after obtaining the registration.
REGISTRATIONS DURING CONSTRUCTION
- High Speed Diesel License/Petroleum License (one time)
Explosive License is required when the applicant proposes to install a total storage capacity exceeding 2500 liters or more of HSD or specified petroleum products. This may also vary according to nature of explosive goods.
- Factory License under Factories Act
- DG Set and Electricity License from Chief Electrical Inspectorate office.
- Consent to Operate (one time) from PCB
Any unit which intends to setup an industry has to obtain Consent to Establish (CTE) known as NOC. The board accepts new applications for Consent to Establish under Water Act 1974 & Air Act 1981 & grant the same, after such inquiry as it considers necessary and on being satisfied that the applicant possesses appropriate pollution control facilities.
After the industry puts up all Environment Management System in place, it can then apply for consent to operate which is together with water consent, air consent and authorisation for hazardous waste is known as Consolidated Consent & Authorization in common parlance (‘CC&A’).
The board accepts Consent to Operate known as CC&A in common parlance under Water Act 1974 & Air Act 1981 & Hazardous Waste (Management Handling and trans boundary Movement) Rules 2008 & grant the same, after such inquiry as it considers necessary and on being satisfied that the applicant possesses appropriate pollution control facilities.
